Notice of Public Hearing to Consider the Naming of the New Unnamed Park at Iliff & Bellaire

Notice is hereby given that the Department of Parks & Recreation for the City & County of Denver is considering the naming of a new park (referred to currently as Unnamed Park at Iliff and Bellaire), bounded by S. Birch St. to the east, S. Bellaire St. to the west, E. Iliff Ave. to the south, and E. Warren Ave. to the north, as “Bethesda Park” in response to a community effort led by a committee formed after park vision planning completed in 2023. This park name serves to honor the Dutch heritage of the area and reflect the impact that the Bethesda Sanitorium later known as the Bethesda Psychiatric Hospital had on this area among several generations of immigrants. Bethesda is a Hebrew word meaning place (or house) of mercy, aptly reflecting the values that the community wants to live on in the park. 


The Parks and Recreation Advisory Board

 (PRAB) will hear public comments on this proposed naming on Wednesday, January 10, 2024 at 5:30 pm at the Board’s regular meeting, currently being held online through Zoom. Access the meeting information at denvergov.org/PRAB

Expanding Housing Affordability: Reminder: Submit your comments to the draft proposal by December 31, 2021

More than 160,000 Denver residents are paying far more than the recommended 30% of their income for housing. In October, Community Planning and Development and the Department of Housing Stability released a draft proposal for the Expanding Housing Affordability project to support the creation of affordable housing needed by our workforce and community members. The draft proposal recommends a mandatory affordable housing requirement for new residential developments above a certain size to ensure that much-needed affordable options are included as new residential buildings are developed.  


The deadline to submit a comment for this round of review of the draft proposal is December 31, 2021.  


The city will use your input on the approach to continue to refine the proposal. An updated proposal reflecting the comments received in 2021 will be available for public review in early 2022.

Timeline and Next Steps




City staff will compile and synthesize all comments received by December 31, 2021, and identify areas for needed refinements. A revised policy approach, including the specific proposed changes to the Denver Zoning Code (DZC), Denver Revised Municipal Code (DRMC), and Rules and Regulations (R&R) will be released for community review in early 2022. Additional outreach and feedback opportunities will be posted on the project website.  


The legislative review process, which includes public hearing before City Council and Planning Board, will begin in spring 2022. 


Denver City Council is expected to consider this proposal in spring 2022. This proposal must be adopted by Denver City Council before it will become effective.  


The proposal balances the immediate need for affordable units with the need to provide adequate time for existing projects to move through development permitting under today’s regulations and linkage fee schedules. As such, it includes the following provisions: 


Projects under Site Development Plan (SDP) review could continue under existing rules if they have a:  



Additional flexibility is proposed for projects that have longer required review procedures under Large Development Review (LDR) or subdivision rules. 


Projects under residential review (one to two units, small additions, etc.) could continue under existing rules if they have a:  



Why are we doing this work?




Denver has an immediate and growing need for housing. As costs go up, many families are spending more on housing, and many are being priced out of the neighborhoods they grew up in. To address that need, the city is working to create more options for everybody. This project will develop tools to encourage the construction of affordable and mixed-income housing across the city. New housing where people can live near jobs, transit and the services they need will help address housing demand and create a more sustainable Denver. This work complements the city’s existing initiatives to help provide much-needed housing for our teachers, firefighters, restaurant workers—people who make our city the great place we all love.

Attached is the Zoning Appeal Application for case #76-2021 which is scheduled to be heard on August 31, 2021 at 9:00AM

 

In response to the COVID-19 pandemic we are modifying several of our hearing policies.  Please see the attached information sheet.  This email contains a lot of important info, so please read all the way through.

 

One of the largest changes is that the BOA will now be conducting hearings fully online/remotely in an effort to promote social distancing and per the guidance of the Denver Department of Public Health and Environment.  All Board Members, City Staff and Appellants will all attend virtually through Zoom. Members of the Public will also be able to attend through Zoom as well.  Members of the public unable to join online may come to Webb Building at 201 West Colfax Avenue, Denver, Room 2.H.14, to comment via computer in person.

 

Another change is that we will now require any documents including exhibits and letters of support or opposition to be submitted no later than 8:00AM on the Monday prior to the Tuesday hearing.  This will allow us to ensure that Board members, City staff, Appellants, and any interested parties will have digital access to all submitted materials.  If you will be submitting additional documents digitally to be reviewed by the Board, please combine multiple files into a single file before emailing it to us.  If you submit multiple documents as individual files, we cannot assure everything will be compiled in the order you intend it to be.

 

Also, if a Power of Attorney form is required because any legal owner of the property is not able to be present, we still require the original notarized form to be submitted (a scan is not sufficient), so please mail the form to:

You may also drop it off in person.  Although the BOA office is not observing regular hours and staff are largely working from home, you may just leave the POA form in the document dropbox at the BOA counter in the Webb Municipal Building.  If you leave documents in the dropbox, please notify us by email either by replying to this communication or emailing boacontact@denvergov.org

 

Hearings are conducted remotely by Zoom video.  If you are not familiar or need help to ensure your comfort level with using Zoom Video, please let us know and we will schedule a demo session.

Finally, the Notice of Public Hearing sign will be delivered to the subject property in order to prevent requiring you to come into the office.  The hearing sign is required to be posted for 10 consecutive days prior to the hearing (which will be the Saturday 2 weeks prior to your hearing).  We usually deliver the signs on the Wednesday or Thursday prior to the Saturday posting.

CPD periodically performs routine maintenance and upkeep on the Denver Zoning Code. This consists of a large number of text amendments code-wide to correct areas where existing zoning rules are inconsistent or difficult to understand, and to make small adjustments that bring the code into alignment with adopted city policy.

WRITTEN COMMENTS WILL BE DISPERSED AS FOLLOWS:

Written comments received by CPD staff by 12 p.m. (noon) on the Thursday prior to the City Council public hearing will be included in the CPD staff report packet that is distributed to City Council.  Written comments may be emailed to rezoning@denvergov.org.  After 12 p.m. (noon) on the Thursday prior to the City Council public hearing and up until 3:00 p.m. on the day of the City Council public hearing, written comments should be emailed to dencc@denvergov.org.  To submit written comments after 3 p.m. on the day of the City Council public hearing, bring copies of written comments to the public hearing and ask the Council Secretary to distribute the comments to the Council.  Notwithstanding the foregoing, in order to provide Council members adequate time to review written comments, members of the public are strongly encouraged to submit their comments prior to the day of the public hearing.

Colorado Station Rezoning (Reposted from CC Member Kendra Black)

As Denver grows and changes, it is important that we ensure appropriate land use around our transit hubs. Certain uses, like self-storage and drive-through businesses are not the best use. In 2018, I worked closely with CPD to pass a text amendment to the Denver Zoning Code prohibiting storage facilities and drive-through businesses within ¼ of a mile from a light rail station. Unfortunately, this amendment does not apply to parcels in Denver’s old zoning code (Chapter 59.)

 

There are two parcels within the Colorado Station area that are still in Chapter 59 and are therefore exempt from this rule. One of the parcels is used as a huge storage facility and the other is the RTD parking lot. Because the storage facility is in the old code, it was allowed to expand into its own retail center on E. Evans Ave. If the parcel had been in the new code, this expansion would not have been allowed.  

 

To safeguard the future use of these important transit hub parcels, I have applied to rezone them into the Denver Zoning Code to C-MX-5. The other parcels in the Colorado Station area are zoned C-MX-20 which is appropriate and consistent with the concepts in the Colorado Station General Development Plan. The neighborhood context for the Colorado Station area is Urban Center which calls for a mix of uses including housing. 

 

I understand that the existing storage facility will be allowed to remain, but that any future development would prohibit that use. I also understand that, if the rezoning passes, the storage use cannot be expanded. This rezoning is intended to preserve the intent of the text amendment prohibiting self-storage around light rail stations and to ensure the future best use of these parcels.

Denver begins project to update Accessory Dwelling Unit (ADU) regulations 

Denver Community Planning and Development is launching a new project to update how the Denver Zoning Code regulates accessory dwelling units (ADUs). This project will not change where ADUs are allowed, but will look at how ADUs are designed. Scope: This project aims to implement Blueprint Denver recommendations via an update to the Denver Zoning Code. This project will not change where in the city ADUs are allowed, but will look at how they are designed, how they fit in with different types of neighborhoods and block patterns, and how updates to the zoning code may reduce barriers to creating ADUs.

 

Expected Timeline: About one year from Fall 2021 – Winter 2022

The Glendale Entertainment District Preliminary Plans Passed


On September 14th, preliminary plans for the new Glendale Entertainment District, which would be located between E. Virginia Avenue, Cherry Creek South Drive, and S. Cherry Street.  The preliminary plan calls for parking spaces being added (over 1,000) which will replace a park, alcohol sales being permitted until 4 am, and open consumption of alcohol within the premises.
